III. What Information We Collect
The information collected on our digital platforms is used to determine important statistical data for Forty Carrots, its partners and members to determine the effectiveness of the content, programs and advertisements offered through our website. We also collect information to provide better services to all our users. The information Forty Carrots collects, and how that information is used, depends on how you use our services and how you manage your privacy controls.
Forty Carrots, its partners and affiliates collect personal contact and demographic information that the consumer willingly provides such as name, address, zip code, email address, phone number, and other information you share, with the intention of using this information for purposes of statistical reporting and targeted promotional campaigns. Forty Carrots and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies together to report how our ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to our website. These cookies are also used by Forty Carrots and third-party vendors to inform, optimize, and serve ads across the Internet based on someone’s past visits to our website.
We will not facilitate the merging of personally-identifiable information with non-personally identifiable information collected through any Google advertising product or feature unless we have notice of and the user’s prior affirmative (ie: opt-in) consent to that merger. However, we may merge or facilitate the merging of personally-identifiable information with non-personally identifiable information collected via other channels.

X. Indemnification
You hereby agree to indemnify, defend and hold Forty Carrots and its affiliates, parents, subsidiaries, officers, directors, owners, agents, attorneys, employees, information providers, licensors and licensees (collectively, the “Indemnified Parties”) harmless from and against any and all liability and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach of this Privacy Policy or the foregoing representations, warranties and covenants, including, without limitation, the Indemnified Parties’ attorneys fees and costs.
XI. Modification of Terms and Conditions
Forty Carrots reserves the right, at its sole discretion, to change, modify, add or remove any portion of this Privacy Policy, in whole or in part, at any time. Indemnity
Each party hereto shall indemnify, defend, and hold harmless the other party, its editors, officers, employees and agents with respect to any claim, demand, cause of action, debt or liability, including reasonable attorneys’ fees, to the extent that it is based upon a claim that, if true, would constitute a breach of any of the indemnifying Party’s representations, warranties, or agreements hereunder.
Arbitration
YOU AGREE THAT ANY DISPUTES BETWEEN YOU AND FORTY CARROTS WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION IN SARASOTA COUNTY, FLORIDA, AND YOU IRREVOCABLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASSWIDE ARBITRATION. YOU ALSO IRREVOCABLY WAIVE YOUR RIGHT TO A JURY TRIAL.
Governing Law and Jurisdiction
All matters relating to the Site and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule (whether of the State of Florida or any other jurisdiction).
Without waiver of the foregoing Arbitration clause, any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida, in each case located in Sarasota County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Minors
The Site is not meant for minors under the age of 13. It is a general audience website, intended for adult use only. Forty Carrots does not knowingly or intentionally collect, disclose, or sell personal information of individuals under the age of majority in their respective jurisdiction without permission from a minor’s parent or guardian. If we become aware that someone under the age of majority has provided personal information to us, we will immediately delete such information from our files. When searching for reservations, you may be asked to provide the ages of any minor guests staying in the room; however, no personally identifiable information of these minor guests is requested or stored.
Our Site is located and hosted in the United States. If you access our Site in a jurisdiction other than the United States, you must be of an appropriate age to consent to the processing of your data under the laws of your country. If you’re under age thirteen (13), please do not provide us with any personally identifying information (such as your name, email address or phone number). Please contact our Office of Data Management if you are aware of any personal information supplied to the Site by a child under the age of thirteen (13) so that it can be removed.
Changing and Deleting Your Information

Data Retention Periods
